Myths and History: The Treaty of Waitangi as “The Magna Charta of New Zealand” a symbol to be associated with the Treaty. In this paper Williams will argue that there are good reasons, though not based on the actual history of Magna Carta or the Treaty of Waitangi, to associate these foundational documents together as important elements of an Aotearoa New Zealand national mythology.

The chapter traces populist appeals to history and English birthright in controversies over land ownership, representation and liberty under law in the first two decades after the Treaty.

The Myth of the “Māori Magna Carta” people. This chapter also proposes that Māori need to be wary of attempts to align the Treaty of Waitangi with any constitutional argument. The emergence of the Rūnanga system in the 1860s is used to provide insight into how the relationship between the Crown and tribes should have operated.
