描述Do the antitrust laws have a place in the digital economy orare they obsolete? That is the question raised by the government‘slegal action against Microsoft, and it is the question this volume isdesigned to answer. .America‘s antitrust laws were born out of the Industrial Revolution.Opponents of the antitrust laws argue that whatever merit theantitrust laws may have had in the past they have no place in adigital economy. Rapid innovation makes the accumulation of marketpower practically impossible. Markets change too quickly for antitrustactions to keep up. And antitrust remedies are inevitably regulatoryand hence threaten to `regulate business‘. .A different view - and, generally, the view presented in thisvolume - is that antitrust law can and does have an importantand constructive role to play in the digital economy. The softwarebusiness is new, it is complex, and it is rapidly moving. Analysis ofmarket definition, contestibility and potential competition, the roleof innovation, network externalities, cost structures and marketingchannels present challenges for academics, policymakers and judgesalike. Evaluating consumer harm is problematic. Distinguishing betweenillegal conduct

Als Organisation schneller lernenThe raging antitrust debates surrounding Microsoft all include, and must face up to, one underlying question: whether antitrust should stay away from high-technology markets.1 There are serious arguments in the affirmative that are based on unique characteristics endemic to high-technology markets.

Gerold Rüdrich,Klaus-P. SchulzeFirst, a disclosure: I have no financial interests in the present Microsoft antitrust suit with the Department of Justice. Indeed, I have never had any financial stakes in any of Microsoft’s legal battles, except that I use some of their products.

https://doi.org/10.1007/978-3-031-25099-6In the last few decades, the markets for computer hardware and software have exhibited very fast growth. The computer sector is a very significant sector of the United States economy and a leading export. Moreover, personal computers are reaching into (i) telephony, and (ii) provision of “content” (movies, video, etc.), two other huge sectors.

Antitrust in the Digital Age,It is, I believe, no overstatement to say that the so-called Digital Revolution is one of the most important economic developments of our age, one which promises to fundamentally change our economy, our business, and our daily lives.
