影响因子This book discusses issues relating to the application of AI and computational modelling in criminal proceedings from a European perspective. Part one provides a definition of the topics. Rather than focusing on policing or prevention of crime – largely tackled by recent literature – it explores ways in which AI can affect the investigation and adjudication of crime. There are two main areas of application: the first is evidence gathering, which is addressed in Part two. This section examines how traditional evidentiary law is affected by both new ways of investigation – based on automated processes (often using machine learning) – and new kinds of evidence, automatically generated by AI instruments. Drawing on the comprehensive case law of the European Court of Human Rights, it also presents reflections on the reliability and, ultimately, the admissibility of such evidence. Part three investigates the second application area: judicial decision-making, providing an unbiased review of the meaning, benefits, and possible long-term effects of ‘predictive justice’ in the criminal field. It highlights the prediction of both violent behaviour, or recidivism, and future court decisions, b

Predictability and Criminal Justiceng and AI to the realm of criminal justice, that is to say, the decision-making process. This chapter sets a general framework for Chaps. . and ., dealing, respectively, with a specific topic. This chapter, indeed, highlights some crucial aspects, that will be fundamental in understanding the follow

Predictability of Violent Behaviour and Recidivismre behaviour, not only at the correctional stage but, in particular, at bail and sentencing. As pointed out in the previous chapter, this is one of the areas in which the use of algorithmic instruments raised more concern. It has been highlighted that the use of automated decision-making processes i

The Gist of the Inquiryreach ‘conclusions’. As anticipated in Chap. ., the goal of the present analysis is to set the premise to ., and not to conclude, a legal discussion about the impact of AI and computational modelling on criminal justice.

Die Ordnung des Raumes: Faust-Topographiens of the parties in trial change if there is no chance to challenge the counterpart’s evidence, because it was generated by an inaccessible algorithm? Fundamental rights, other than privacy, come to the attention and, in particular, the primary and crucial condition for a fair trial, the equality of arms between the parties.
