Verdinglichte Rechteemdbesitzer war gegenüber jedermann zum Besitz berechtigt und hatte daher den gleichen Rechtsschutz wie ein Eigentümer, ALR I 7 § 161. Man verstand die Klage als eine Erweiterung der actio Publiciana. aber auf dem deutschen Recht beruhend.
