Das BGB bezeichnet die körperlichen Dinge mit dem terminus technicus „Sachen“ und definiert in § 90 Sachen als „körperliche Gegenstände“.. Gegenstand ist also der Oberbegriff, er umfaßt alles, was Rechtsobjekt sein kann, z.B. auch Rechte.

Unmittelbarer Besitz; Erwerb und VerlustAusgangspunkt der Besitzlehre ist der unmittelbare Besitz. Das Gesetz definiert den Begriff des Besitzes nicht; da der Besitz eine soziale Tatsache ist, kann grundsätzlich auch nur die Verkehrsanschauung darüber entscheiden, wer Besitz hat.
