Verdinglichte Rechteemdbesitzer war gegenüber jedermann zum Besitz berechtigt und hatte daher den gleichen Rechtsschutz wie ein Eigentümer, ALR I 7 § 161. Man verstand die Klage als eine Erweiterung der actio Publiciana., aber auf dem deutschen Recht beruhend.

Schutz des unmittelbaren Besitzesstellt, der keinerlei Recht zum Besitz hat, z.B. also einen Besitzer, der die Sache durch Raub, Diebstahl oder Unterschlagung erlangt hat. Ein solcher Besitzer ist nach den §§ 858 ff. in seinem Besitz grundsätzlich gegen jede Störung geschützt, mag sie auch vom Eigentümer ausgehen.
