Eine Zeugin Jehovas klagte auf Schmerzensgeld wegen einer bei ihr durchgeführten Bluttransfusion, in die sie aus religiösen Gründen nicht eingewilligt hatte. Das Landgericht München I wies die Klage mit Urteil vom 24.6.1998 ab. Das Oberlandesgericht München wies die Berufung mit Urteil vom 31.1.2002 zurück.

,Einführung,t unheilbar krank sind, lebenserhaltende Behandlungen ab. Zu denken ist insbesondere an Patienten, die aus religiösen Gründen die Einwilligung in eine bestimmte medizinische Maßnahme verweigern, oder an Menschen, die ihrem Leben - aus welchen Gründen auch immer - mittels Selbsttötung gezielt ein Ende setzen wollen.
